Seanus, let's just file that last comment of yours under BUI (Blogging Under Influence) and let's all forget about it. You're welcome.
I'm sure that a "leading legal authority" of your statue knows that during a trial authorities usually hold in detention suspects of violent crimes or suspects who may be a flight risk. BTW, the trial has begun some time ago and in fact is almost over :)

On Polish TV, TVN. I have been drinking but that hasn't clouded my judgement. The guy who found the phone wasn't DNA tested and he could have been a suspect. The English system is different from the Scottish system in that the English system has never recognised the 'not proven' verdict. This has dragged on since 2006. I've studied the 'admissibility of evidence' extensively and know that there hasn't been a full disclosure to date. The barristers (advocates in Scotland) consider him to be not guilty. Lay off the drink buddy, it is damaging your brain.

The 18 year old guy who found the phone spent two nights in jail awaiting the results of DNA and fingerprint tests, as reported in the UK media

He was released without charge and rightly so.

Are Jakubs friends and family honestly trying to pin this on a kid?

hasnt it already been acknowledged that the first dna test proved negative but there was argument that the sample had been contaminated, hence the second test?

More spin I'm afraid.

No doubt the author is a friend or family member.

The first sample did not match as the computer crashed during the initial test.

The defence did not question or refute the DNA match. Nor did they carry out their own tests. This option has been open to them throughout the last year but they chose not to. That itself speaks volumes.

The defence have a software error on their side so there was no point carrying out their own tests when a match was a certainty

His shirt didn't check out with the original CCTV capturing. Did he change his shirt in 2 mins? Plausible. I'm trying to be objective here mong. At first, there was a match, then there wasn't, not vice-versa. The quality of the British testing is in question and it needs to be clear and thorough.

This whole case reminds me more and more of the O.J. Simpson's case in the US. No matter how overwhelming the evidence was (DNA!), some people claimed that OJ was innocent. It almost looks like a 101 lesson in psychology of a crowd again...

There is being objective and there is being objective.

DNA match top the scene (semen)

He admits following the woman home, but claims he took a turning and another man, indistinguishable in appearance and with the same DNA appeared at 3 am to commit the offence.

Wearing the same clothes as the man seen inches behind the woman in CCTV stills.

Destroyed his clothes from the night of the attack. (the police searched for days looking for them).

Picked out of CCTV stills by his boss at work and his own sister.

Victims handbag and phone found yards from his doorstep.

No alibi whatsoever for the time of the attack.

Oh yes, and this second man (wearing the same clothes and with Jakub's DNA) was nowhere to be seen on any CCTV footage from the city, despite the police checking over 1000 hours from council cameras and cameras of all residences/shops within a 2 mile radius.

It is like magic, he appeared from nowhere.

Or, just a crazy suggestion, it is Jakub? Not a man with Jakub's DNA and clothing

Whats the best bit of defence his mates have come up with?

Why would he rape an older woman.....frikkin pitifull. Like I say,lets hope he does end up with his nuts in a basket,pity castration is not a punishment.

He had lots of women friends,why would he rape a woman twice his age?

The defence lawyer did sink pretty low with that one, and in my opinion alienated the jury in doing so.

Surely you never mention the crime if you are defending a man accused of rape? Bringing up that he could easily screw his girl mates if he wanted to is pretty sad

the figures for rape acusations that actually get to trial are so minute that,well,all things given,you have to kinda think there may be somthing in it all.
Like I said,innocent untill proven guilty....

I honestly don't know how he thought he could win this at trial?

Plead guilty before trial and you will serve a way smaller sentence than if a jury finds you guilty.

There is a real shortage of good info on the net, a lack so big that I can't comment either way to be sure beyond reasonable doubt. Any good websites that maybe I haven't unearthed? I know many legal websites but they all require payments. Sorry, I'm Scottish, don't do unnecessary payments

It's a remarkable coincidence that the police couldn't find his shirt. Also, a match is a match. A semen match would never have been made so precisely, 1 in a billion. How could the English authorities make such a hash of it tho? Notley's testimony is what I'm after now

the forensic scientists testified that a computer error stopped the first sample being analysed correctly.

Second one was a perfect match.

Defence did not question it or carry out their own independent tests

I fully entertain the possibility that he did it. On a rational assessment, with the info that I have, on the balance of probabilities he is guilty, but that's the civil standard and not the criminal standard. U can't rely on character assessments. By all accounts, I was a nice lad with many friends but, trust me, there were times when I got hellishly worked up after a night out and could have lashed out quite ferociously. Rape is a different kettle of fish tho. This taxi driver is rather convenient but he seems to have more psychopathic potential.
