Awaiting too long court date for divorce in Poland

Hi my wife applied for divorce in Poland, Last year in December, 1st thing it was too much hassle to register the marriage, which happened in May 2012.Her Solicitor sent the documents to the court in May, We didn't get any date. She was keep pushing for the date. Solicitor rang the court 3 weeks ago( 28 oct) & they informed that court is trying to establish to contact me(husband) to defend in court. We both are happy to be divorced and we have no kids or property to gather. So her solicitor asked me to sign a draft, which states that I wave all my rights to defend in the court I would voluntarily accept the divorce. It has been sent to the court 2 weeks ago. Can anyone tell me how long will it take to get the date in court after this all hassle? This case is in Warzsawa.

Lets hope she doesn't change her plans and go for an at fault divorce then. It could be costly.

From past experience you could be looking at six months. Things take time in Poland. Not for any reason you might understand. It's just the Polish way.

Er, that might not have been very clever. You did make sure that the document states that you both want a divorce in which neither party is found to be at fault, didn't you? If not, you could end up paying her cash every month until one of you dies. Even better, if you remarry, she can have her alimony increased to take into account the extra income your new wife brings to your household. This can be the case if both parties are found to be at fault.

I have played my cards, I have my safe side, so it shouldn't be a problem, I am just concerned about the date and divorce. It is just frustrating i want to get it done and over with.

It must be frustrating but it will take 2 to 4 months until the whole process is done. And even when the case is settled at the court, the divorce still isn't official, you have to wait 2 or 3 weeks until the court authrizes the issue as settled. Then you are finally able to get the copy of you divorce case.

I am hoping to get it done sooner the better, Cant really wait, because of this marriage, i am facing too many problems in Ireland, I might loose everything, if this is not done with short time. :(

I have no idea if there's any way to make the process faster. Prior to the court decision almost all the procedure is done by correspondence by post(letters) so it's slow.

Make sure you ask the court to appoint an interpreter, because if there's no interpreter person the decision is postponed for another 2 or 3 months!

Thanks Ryoh, its one way divorce with out consent , so i will not be in Poland. I hope to get the date soon.
