Polish Law Advice for everyone

HI I 'm a student from Poland and I live in £ód¼. I'm study law if you have any problems in poland or you only need advice you can write mi on gsynal@inbox.com

How long can a person be held by police without being charged with a crime? An acquaitance was held for over three months but never charged with a crime. He was caught with someone who did commit a crime, and the police were holding him to see if he would implement any others in the crime. He was evntually released in January of this year.

Generlly speaking police in Poland may held you only for 48 hours but In the case of your friend there was a high degree of probability that he commit a crime with someone else. And in this case the public prosecutor take decision about charged with a crime. It is charge under article 249 of the polish criminal code.But if your friend didn't commit a crime and have nothing with this certainty maybe the prosecutor break the law.Then your friend can go to the court for compensation.But I must see the documents from the police,prosector and court to be sure that everything is ok.

Are you allowed to criticize Poland, the Polish government or freely express a political opinion in Poland today? What is a link to see the censorship laws in Poland today ( I need it in English as I cannot speak Polish--- yet ).

For example, if I am an American and I say "I hate America" or "I hate George W Bush" I can't go to prison for that or even be arrested (usually, that is--unless, while I am yelling it, I am also running toward the president with a weapon at the time, for example).

What are the limits of free speech in Poland?

I believe bookratt is just trying to make a point.....we can criticize our country, government and even the president without fear of being arrested.....does the same hold true in Poland (public criticalizations of govt.) I think that's what bookratt is asking.

are there any laws there which protect the average polish worker? especially
female? and is there a EOE in place.

say for instance demeaning work conditions?

Yes of course like almost every country of the world we have in poland Labour Code.We must also implementing to our polish all Directives of the International Labour Organization.Naturally Polish Labour Law protect womens in pregnant and generally female usually work in poland must work shorter than male because womens work up to the 60 years old and go to the retire.Men must work 5 years longer.In teory there is EOE but not in practice.For exemple womens still earn less than men on the same position and men also have better position than women have.But fortunately if you are smart and resourceful you can find good paid job And you will be satisfied.

Hi Serpico I have no specialization yet but in the next year I will take the comercial law and civil law I think...
Now I have a lot of basic kinds of law like criminal law,eu law,civil law,tax law,labour law etc.
Sorry but my english isn't quite perfect.
What does it mean ec competition?
Are you also study a law.If yes then where and what kind?

Thanks Ranj, that's what I meant.

I am asking this so that when we talk with Poles and they with us, while we are there, we don't say something illegal accidentally. We may be asked about politics quite bit while we're there.

I keep hearing about censorship laws in Poland on this board, but no one has supplied links to those laws. So I still don't know what they are talking about.

I googled censorship and Poland but the articles are scholarly, not "real life, real world" examples and I want to hear this info from a Pole who is living in Poland and knows what they mean in everyday life...

Some things will get you into trouble. There is the famous case [on the threads] about the guy who called the PM or President a f***ing duck. Hubert, the guy in question was eventually released without charge. Probably the prosecutor realized that he would have to charge half the country with the same offence.
Don't worry, your friends will let you know if you say to much.
However, I really don't think you will have a problem.

thats interesting... i do mostly the same ... property, criminal, civil, eu law... i also intend to specialise in company and commercial law.. thats where all the big bucks are!! :)
competition law is all about policing the way big companies operate.. ie.. if they are abusing their power in the market.... i study in UK..

its funny because i have'nt come across one eastern european law student yet here... whereas there are plenty of other europeans... maybe you should do a little marketing there.... i certainly wouldn't mind if a few polish hunnies were in my law class.

It's interesting reading some of these threads...makes me see more and more that even though the US has it's issues...in the US you really do have a few more freedoms than some other places...yet the US people don't even see it
