Sorry to hear that. Don't give up, just try to contact an immigration lawyer and demand a court hearing.

You can marry him and adjust his status.
Since he overstayed his visa he won't be able to come back for at least 10 years.
But this just proves that the US is cracking down on illegals who overstay their visas

it's too late for that now... he will get deported if a lawyer doesn't help...

immigration institution is very complicated in its simplicity...

yeah, I wish some of these guys (convex, ironside etc) from the other thread would join us now to see what's going on.

To worried

Anyway, your best bet is really to contact some lawyer. I personally don't believe it will help much but at least you'll try to help him. Marriage is also an option but since he's already in custody it might be too late for it too.

well ive been on this comp 4 hrs..and theres a couple things
i can file for a( petition for alien fiance ) that gets him 90 days ..but its complicated..ive ben reading cases and if he outstayed his visa they look down on that..and im not sure i wanna marry..if i dont theyll find him jus by looking 4 me..maybe pay somone else 2 do it? ikd...

matteroftaste  Feb 9, 10, 04:51    #9
Whatever you'll file for it's gonna cost you some serious bucks and there's a question if in this situation, where he's already in custody if it's worth it because I'll be very honest with you, I believe it's too late now. Sorry about that but that's the way it looks like.

I know this girl that overstayed her visa for over 4 years then went back to Poland for family reasons, and now she cant come back to the US for 10 years.

Thats pretty much guaranteed a deportation, It might be too late even for an attorney?

matteroftaste:

I don't know how it works in Poland but I guess it all depends what kind of crime he committed in Poland.

I used to teach in Poland for a while but I'm back home now.

what is his crime? Can you possibly spin it into asylum request? It may buy him some time?

Don't do anything stupid to attract unwanted attention. Keep your nose clean and your mouth shut.

expired visa..want to stay in the us

1. Go back where you came from and go through the legal steps to emigrate to the US (or get a visa that will allow you to stay longer)

2. Try to convince US immigration that you're Mexican, change your name to Covalsquez or Gonzalska.

3. Go elsewhere looking for sympathy in your endeavor to break the law to suit your whims. By overstaying your visa, you're subverting everything that built what you find so attractive. US culture is founded on people OBEYING THE LAW, WHETHER THEY LIKE IT OR NOT!!!! It's not based on just doing whatever you want to do.

My sympathy guage is on ........ minus 2.

It's very high. Mine is on "electric chair stand-by" ;-)

Worried. Don't do anything stupid and don't ever try to use somebody to stay, if you have some morals. Respect the country you pretend to like.

And I'm taking the opportunity to quote a story that happened to my ex-(Polish) girlfriend. She was legally working as a doctor for 2 years in the U.S. a few years ago. She met a Polish guy there and thought that she had found the man of her life, expecting them to get married and have children, happily going to church every sunday together. But he found himself in an illegal situation (probably expired visa). He wanted so badly to stay in the U.S. that he met an American girl of Brazilian origin which he married after 3 months, dumping the Polish girl straight away (but telling her he still wanted to have sex with her on the side because she was the one he loved). The poor girl was so devastated and just got back to her mother in Poland, with an emotional shock from which, I suspect, she never fully recovered, and a complete distrust in men.

Some people are just ready to do anything to stay in the so great America :-/ It's disgusting.

Did she do it while she was your gf? If you don't mind to answer it.

How it works receiving a package from abroad for all of us who aren't residents  How do my Polish relatives get a visa for visiting me in Houston?
