Attorneys for a bartender allegedly beaten when she refused to serve an off-duty police officer more alcohol, an incident caught on video and viewed around the world, filed a federal lawsuit Monday against the officer and the city of Chicago.

Security cameras captured video of a large man punching and kicking the petite Karolina Obrycka in a Feb. 19 attack that made international headlines.

Obrycka, a 24-year-old Polish immigrant, said Monday she still fears retribution from police. She said she even changed her hair color from blonde to light red to avoid being recognized.

Theres another lady on the news here this morning that was beat up by the Chicago Police they showed her pic, with black eyes and a broken nose. All she was doing was walking across the street. Something needs to be done about these thugs!!!

Abbate appeared in court Wednesday to answer what were previously misdemeanor battery charges and are now felony charges, which involve the state's attorney's office. "Those acts merit a felony charge," assistant state's attorney David Navarro said.

While the charges are against Abbate and not the city, an attorney who specializes in police misconduct and civil rights says the likelihood of the city having responsibility is very low. "People would want to blame city -- a natural inclination because he's a Chicago officer. But, he's off duty, in a bar, not clothed as an officer, probably not seeking to arrest her. I'm assuming now, because I haven't heard the tape, because he's intoxicated," said civil rights attorney Blake Horowitz said..

"So all of those things are elements of somebody who's off-duty. And when they're off-duty, and they're not acting in what's called the 'scope of employment.' Within the scope of employment, the likelihood of having city responsible is very low,"

Abbate could face two to five years behind bars if convicted. Police say, in a statement, that he will likely be terminated after 12 years on the job

Seanus: I felt it to be a thread worthy of discussion. I was actually in there about a month ago, it smells really bad and the bathroom is still flooded.. Its all old men gaulking over the bartenders, thats the only good thing is they have pretty girls working there, I dont know how they handle the smell..lol I cant believe I used to hang out there

She cut him off because he was drunk, so thats when he went off on her. The guy is an a-hole, Ive seen him around before. I hope he goes to jail,but his daddy is a big wig in the police dept. Without that video tape he would surely have gotten away with it. Thats your Chicago Police dept for you, they dont protect the public, they are the ones to be afraid of:(
