Luksa - Big problems with developer in Lwowska, Krakow

Sean, - its discussion about clone of Luksa - Pawo company, which have exactly similar situation like with Lwowska investment ...

It seems that their finansial "piramide" collapsed now due to general problem with real estate investment - no new customers so they are lack of money now ;)

Any truth in the rumour that Luksa have obtained planning permission for Lwowska development in Krakow - if so how do we verify?

Hello everyone,

we have heard that demolition is now underway on site, this information came from Neodom, has anyone heard anything new or can confirm this is the case.

Look have you read this forum carefully. People are telling you not to trust Luksa as they are conmen. They are operating a sort of pyramid scheme. They and Neodom are the only ones making money here. I am sure your lawyer has advised you on what course of action to take. If you have any business sense then invest somewhere else. This other forum above refers to another development of Grupa Pawo (Luksa) that Neodom had originally on their books. After the Lwowska debacle they removed it. This has now been repackaged as a new development and is being sold by Neodom. I wouldn't have much faith in Neodom as they are making money either way.

I got confirmation that demolition will be finished till end of July and that Luksa should get the permission building for Lwowska very soon.

Our Polish solicitor has instructed us that builder is preparing to draw up revised addendum to original agreement based on the fact that demolition has begun/is complete? and his submission of revised plans to plannig authorities? It remains to be seen what that will entail and if it is our favour. Watch this space.

I bought an apartment in this development at the early stages over two years ago and have susequently terminated the contract with some considerable effort. Just a few ppints below from previos posts.

Thay are trying to sell the development but it was unsuccesful at auction.


Why were Luksa tring to sell this development?

I work for a real estate agency here in Krakow. We had two clients invest in this development with Luksa (called 'Lwowska Residence'). I am not sure the reasoning behind the developer not wanting to proceed with this investment. More than likely they sold it too cheaply in the first place, and either want to sell on the plot or resell the apartments at higher prices. Obviously, this is a developer not to be trusted. My advice to you is to try and get your money back, and then move on. One of our clients has already been paid his money back (plus a penalty), and the other one should have his money back shortly.


Andy has his ear to the ground in terms of what is going on here. If he has terminated the contract for his clients then I would pay attention.

I will know more by end of this week. Solicitor trying to file for 'limitation' which protects our rights beyond 31st December. Its essentially a piece of protection legal process so that we don't lose our shirts whether he builds or not. Though to be fair our solicitor having trouble finding Luksa.

hI, I INVESTED IN THIS DEVELOPMENT WITH LUKSA ALMOST 3 YEARS AGO.
THE DEVELOPMENT COULD NOT PROCEED ACCORDING TO THE CONTRCT BECAUSE OF PLANNING ISSUES. MY SOLICITOR HAS FILED FOR LIMITATION TO RESERVE MY RIGHTS.
STILL LUKSA ARE NOT RESPONDING TO MY SOLICITOR. ANYONE KNOW IF LUKSA IS STILL SELLING APARTMENTS IN THIS DEVELOPMENT?

Luksa is not selling any apartments in this development at present. They are building something nearby on Plac Bohaterow Ghetta which they are calling Villa Wisla, villawisla.pl

I know this is still unresolved for a lot of people that bought in this investment, and that many investors are still waiting to get their money back. I wish you luck and suggest you keep your lawyer engaged on this case

Does anyone know if luksa can be forced /given an ultimatium to resign on the oringal premliminary contracts for the development on Lwowska street and to give back the monies with in 60 days of signing?

Could a number of investors whom are still waiting for thier monies , perhaps joint forces and take one court action against this company as opposed to each investor separating taking him to court?

The short answer is no.

If attempting to get your money back then you should get legal advice. I managed to get them to repay my deposit, plus expenses, plus a penalty fee. I didn't have to go to court but it took some considerable effort on the part of my solicitor to secure this. You should also conatct their offices yourself directly. To be honest Luksa don't give a s**t.

im am currenly waiting to get my money back also. The whole thing has been a disaster.
I would be interested in mollys proposal to take one joint court action.Would anyone else be interested in this?

Am chasing up confirmation on this from our solicitor in Krakow - seems to me that this forum is more informed than most on matters Luksa. Its all very well getting building permit - will Luksa build it now. We are still tied in to our original agreement from 2006 at 2006 prices!

Can you provide any sort of solid confirmation or proof that Luksa has acquired a permit for the Lwowska site. We are having real difficulty getting any verifiable information on this.

i cannot believe people are still tied up in this investment. what type of advise are you guys getting. only in poland would this be accepted.

Investigations by my agent and solicitor in Krakow left me in no doubt that this developer was best avoided. I also had the pleasure of meeting Mr Luksa & his associate on a few occassions myself. I cancelled this contract and got my deposit returned plus all expenses & additonal penalty last year. If your solicitor is any good then surely they have initiated some sort of court proceeding as this is the only sure way to get the attention of Mr Luksa. Best of luck!!!!!!!!

I heard this investment will be finished with 2 years from now ; they should start the building quite soon.
